Welcome to Modern Agency SAS ( Lefty, "we," "us," "our") privacy notice for registered social media creators.

We collect publicly available information about content creators (“you” or “your” in this privacy notice). This information, or “personal data”, is made available on Lefty (the “platform”) for its customers ("brands") to identify, manage and track their relations with creators. 

Modern Agency respects your privacy and is committed to protecting your personal data. Modern Agency is GDPR compliant.  

1. What we do

1.1 Modern Agency SAS ( Lefty, "we," "us," "our"), a simplified joint stock company incorporated under the laws of France (societe par actions simplifiee) registered at the Trade and Companies registry of Paris under the number 810 844 399 is the owner of the https://lefty.io, https://dashboard.lefty.io and https://creators.lefty.io websites (collectively, the Platform). We are based in France, our headquarter is located 48 rue Montmartre, 75002 Paris, France. 

1.2 Lefty is a platform that connects brands to social media content creators. Lefty enables brands to find, manage and pay content creators. Lefty allows creators to collaborate with brands on creative projects of their choice.

1.3  Lefty is an independent company, not associated with Facebook or Instagram. 

2. Personal data

2.1 Personal data, or personal information, means any information about an individual from which that person can be identified.

2.2 We collect, use and store different kinds of publicly available personal data about you which is obtained indirectly via secondary sources such as social media networks and other Internet sources. This personal data may include the following:

  1. Your name;
  2. Your social media handle and associated metrics; 
  3. Posts which you have shared publicly on social media; 
  4. City/Country of residence and language; 
  5. Email address (if mentioned on your social account account); and 

2.3 We process the data to give more insight on your profile to the brands, including: 

  1. Industries you’re interested in (Fashion, Sports, Beauty, etc…);
  2. Brands you have partnered with and sponsored posts;
  3. Other social networks that you are active on;
  4. Audience data and statistics.

2.4 We store and update your data on a regular basis.  

3. Use of your personal data

3.1 We will only use your personal data to the extent that the law allows us to do so. We use your personal data to allow brands on our platform to identify and contact creators, as well as manage and track their relations with them. 

We will use your personal data where it is necessary to pursue our legitimate interests and your interests and fundamental rights do not override those interests.

3.2 As part of these legitimate interests, 

  1. The platform may benefit you as a social media creator by facilitating your connection with brands looking to partner with content creators, monetize those partnerships and ascertain your expertise in front of other brands. 
  2. The platform provides a benefit to both brands and creators by allowing them to build and nurture long-term relationships. 

4. Email communications 

4.1 We may send you occasional communications to make your experience with Lefty optimal (eg: a brand is interested in collaborating). You may control whether you would like to receive those emails in the https://creators.lefty.io/account tab.

4.2 We do not engage in any marketing with your email nore send promotional offers.

4.3 From time to time, we may send creators important notices, such as changes to our terms, conditions and policies. Because this information is important to creators interaction with us, they may not opt out of receiving these communications.

5. Data Privacy

5.1 We only use your personal data as described above to facilitate the interactions between brands and content creators.

5.2  We do not sell your personal data to anyone.

5.3 We do not share your personal data outside the Lefty platform. The only instances that we may have to share your personal informations are:

  • Where we are required to disclose by a EU Court of Law under subpoena.
  • If a company acquires our business. If this happens, we will post a notice on our home page.

6. Data location

6.1 Our data is stored in the EU on the Google cloud platform https://cloud.google.com/ zone europe-west1 (located in Belgium), and on Online https://online.net Paris and Amsterdam datacenters.

7. Your rights

7.1 You have the right to request erasure of your Personal Data. This enables you to ask us to delete or remove Personal Data where there is no good reason for us continuing to process it. Your profile will be immediately hidden and we will proceed to delete any data that we have collected about you. We will not retain any information about you, anonymized or otherwise. If you want to delete your profile, please unsubscribe by sending an email to talent@lefty.io

7.2 In order to exercise any of your rights listed above, please contact us using the contact details provided in section “Contacting us” of this notice. As part of our compliance with GDPR, we will have sent an email informing every creator on our platform about our privacy policy and their rights mentioned above.  

7.3 We try to respond to all legitimate requests within seven days. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

8. Opt-in

8.1 You can opt-in to Lefty platform, using the website https://creators.lefty.io. You may edit/delete any information at any time. 

8.2 Lefty installs a cookie to differentiate you from other users and provide the “Logged-in” experience. Our cookie doesn’t track anything besides your user id on the Lefty platform. Our cookie is deleted when you use the “Logout” feature.

In addition we include the following third party SDKs which may install a cookie:

  • Google analytics: a service to collect anonymized website visits which helps us improve the product design.
  • Intercom: a service to chat with the Lefty team for support.

8.3 Creators join the Lefty platform by using the so-called “Login with Facebook” feature as provided by the Facebook platform (https://developers.facebook.com/policy).

Any creator with a public instagram account, linked to a Facebook business account may join the platform. If you grant Lefty access we will be able to access the following data:

  • List of public posts on your Instagram account.
  • Analytics: performance/audience report for a given post.

We will use your Instagram posts to enrich your creator profile and have brands get the most accurate opinion about your creative work.

We will only share your analytics data with Brands that you have agreed to partner with, if you chose to do so. You may at any time revoke this access on a brand to brand basis by going to the https://creators.lefty.io/campaigns tab.

8.4 You may opt-out and leave the Lefty platform at any time. To do so, please go to www.creators.lefty.io and unsubscribe by sending an email to talent@lefty.io. Upon deletion of your account, your profile will be immediately hidden and we will proceed to delete any data that we have collected about you.

Any piece of content that you have uploaded to the platform specifically as it was bought by a brand will still be available for that brand to retrieve. If you would like to dispute the sell of a piece of content, please contact us at contact@lefty.io.

9. Acceptance of these terms

9.1 By using this Site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use Lefty, do not join the creators platform and unsubscribe by sending an email to talent@lefty.io

9.2 Your continued use of Lefty following the posting of changes to this policy will be deemed your acceptance of those changes.

10. Changes to this policy

10.1 We may update this privacy policy to reflect changes to our information practices. If we make any material changes we will notify creators by email (sent to the e-mail address specified in a creator’s account) and by means of a prominent notice on the Platform prior to the change becoming effective.

10.2 Any access or use of the Site or Services by you after such notice shall be deemed to constitute acceptance by you of such changes, modifications or additions. We encourage you to periodically review this page for the latest information on our privacy practices. If you do not agree to abide by these practices or any future privacy policy, please do not use or access the Platform.
